Wahl Barber Battle 4 for 2020 Official Rules

Void in Arizona, North Dakota, and where prohibited. The Wahl Barber Battle 4 (the “Contest”) is intended for viewing and participation in the United States and District of Columbia and will be construed and evaluated only according to laws within the United States. Contest begins on or about 11:00:01 a.m. Eastern Time (“ET”) on October 1, 2020, and ends at 10:59:59 a.m. ET on January 5, 2021 (“Contest Period”). The Video and Entry information will be referred to as the “Video” or the “Entry.” The individual who submits the Entry in the Contest will be defined as the “Entrant.”

Entry Fee

A Contest Entry fee of $75.00 USD is required to be paid via credit card during the Entry process or at the time of completion of each Entry.

Eligibility (Contest Entry)

Each Entrant must be at least 18 years of age or the age of majority in their state of residence, whichever is older, at the time of Entry, and must be a legal resident of one of the United States (exclusive of the voided states) or the District of Columbia. Proof of current Barber/Cosmetology Licensure (as issued by Entrant’s state of residence) will be required. Entries must include a valid ID Number/License Number. Each Entrant must be a member of the Wahl Ambassador Program. Those not already a member of the Ambassador Program will be automatically enrolled at the time of Entry. Enrollment in the Ambassador Program is free. As of the Contest start date, Entrants must have: 1. Authorized Internet access that utilizes a web browser and/or active data plan; 2. A mobile phone with SMS/text messaging capabilities; 3. Access to a video recording device. Employees, officers and directors of WAHL Clipper Corporation (“Sponsor”) and of its parent company, affiliates, subsidiaries, advertising agencies, and promotional agencies, and members of those individuals’ immediate families (spouse, parent, children, siblings, and their respective spouses and children, regardless of where they reside), and persons living in the same household (whether or not related) of such employees are ineligible to enter or win. By participating, Entrant agrees to these Official Rules, and the decisions of the Sponsor and/or its judges, which are final and binding in all respects.

Eligible Products and Tools

Entrants may use only WAHL® clippers, trimmers, and shavers as part of the Contest and are responsible for procuring these tools. Entrants must not use any straight razors or shears. Brushes, capes, and styling products that are not part of the WAHL® catalog may be used but at no time may an Entrant display, film, photograph, mention or describe any product names, brand names, logos or other identifiable marks other than WAHL®. Submissions found to be using ineligible items will be disqualified from the Contest.

How to Enter

All Entries must be submitted online at www.wahlbarberbattle.com (the “Website”) in Video format. Entry Videos, or any portion thereof, must not be released, shared, published, or posted on any social media platform until the Contest has ended and winners have been announced. To Begin: complete the Ambassador Registration by entering your first name, last name, email address, mobile phone number, business name, professional license number, and your state. This will start the Entry process. Select “Go to Battle” and continue with your personal information. At this point, or at any point during the Entry process, you may select “Save and Continue Later.” When you select “Save and Continue Later” you will be given a personal URL that will allow you to return to your Entry form and provide additional information for your Entry at any time during the Contest Period. Be sure to save this URL and/or request the URL be sent to you via email. NOTE: Your personal URL will expire in 90 days. Create an Entry: Each Video Entry must show work on a live model or mannequin, in three different categories. 1. Afro; 2. Taper; 3. Signature Cut. Personal Information: Entrants will be asked to complete an optional short biography section. In addition, each Entry must include the Entrant’s first name, last name, street address, city, state, ZIP code, email address, phone number, date-of-birth, and optional social media information, if any (Facebook account, Instagram account, TikTok account, Twitter account, and YouTube channel). Employer/Business Information: Each Entry must include Entrant’s business/employer name, business/employer address, city, state, ZIP code, and phone number; valid State ID Number/License Number. Entry Fee: Enter a valid credit card number, name as it appears on the credit card, ZIP code, credit card CVV code, and credit card expiration date. Model Information: Enter information for each live model, including name, email address and date-of-birth. You must complete and submit a signed talent/publicity release (signed by parent or legal guardian of model who is a minor) for each of your models at the time you complete your Entry. Submitting Your Entry: Completed Videos must be uploaded to the Website, using the upload instructions provided on the Website. Video must not include anyone other than the Entrant and one model for each of the three style/cut requirements. Limit one Entry per person. Normal Internet access and usage charges imposed by your online service will apply. Standard data rates may apply to Entries submitted via mobile device. Any attempt by any Contest Entrant to obtain more than one Entry in the Contest by using multiple/different email addresses, identities, registrations and/or logins, or any other methods will void that Entrant’s Entry, if discovered by Sponsor. In the event of a dispute as to who submitted an Entry, the Entry will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of registration. “Authorized Account Holder” is defined as the natural person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. All Entry information will become the exclusive property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into.

By entering, each Entrant grants to the Sponsor and its licensees a world-wide, perpetual, non-revocable, royalty-free, sub-licensable license to publish his/her Video as well as derivative works based thereon on the Website, in Sponsor’s apps, social media, television programming and through any and all other media, now known or hereafter devised, in any manner related to the Contest without prior notice, approval or compensation. Entrant hereby agrees that Entrant’s Video will not be released, shared, published, or posted on any social media platform until the Contest has ended and winners have been announced. Entrant represents and warrants that the Entrant has received all permissions from models appearing in the Video to grant the rights granted herein and that Sponsor and its licensees’ use of the Videos as provided for herein will not violate the rights of any third party. Entrant agrees to provide such permissions in writing or another form acceptable to Sponsor. Sponsor may moderate Videos before posting and reserves the right to reject any Entry that, in its sole and absolute discretion, is determined not to meet the specifications set forth herein.

Video Submission Requirements:

Each Entrant has between 15 and 18 minutes total to demonstrate the required cuts. Each cut must be shown in its entirety using time-lapse or other editing techniques to demonstrate the complete cut/styling process, including before and after views. Entrants are required to provide narration and specific details during the cut/styling process.

By entering, each Entrant represents and warrants that the submitted Video is in compliance with all of the foregoing requirements. Each Entrant agrees to indemnify, defend and hold Sponsor harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties.

If Sponsor determines, in its sole discretion and at any time during the Contest, that any Entry violates the submission requirements, is otherwise unsuitable, offensive, or in poor taste, or violates these Official Rules, Sponsor reserves the right to remove and disqualify the Entry. Sponsor retains sole discretion as to whether any Entry satisfies the submission requirements and these Official Rules.

Judging

The judging will begin immediately following the close of the Contest Period and the winners will be announced on or about April 1, 2021. Should more valid Entries be received than are expected, the Sponsor reserves the right to change or delay the announcement of the winners to allow additional time for all Entries to be judged. Entries will be judged by the Sponsor, Sponsor’s representatives and by members of the Wahl Education & Artistic Team (W.E.A.T.) (the “Judges”). No information regarding Entries or judging, other than as otherwise set forth in these Official Rules, will be disclosed and Judges’ decisions are final.

Entries will be judged and awarded points based on the following criteria:

THIS CATEGORY REQUIRES THE BARBER/STYLIST TO SHOWCASE THEIR PERSONAL STYLE AND CREATIVITY THROUGH THIS CLASSIC BREAD AND BUTTER CUT.

DESIGN WORK AND HAIR COLORING MAY BE USED. DO NOT USE ENHANCEMENTS.

Winning

Judging will be held from among all eligible Entries received. The Entry with the highest score accumulated throughout the judging process will be declared the Grand Prize winner; the Entry with the second highest score accumulated throughout the judging process will be declared the Second Prize Winner; the Entry with the third highest score accumulated throughout the judging process will be declared the Third Prize Winner with corresponding prizes awarded. If there is a tie for the Grand, Second, or Third Prize, Judges will confer with tie-breaker judges from W.E.A.T. and/or Wahl Select Barbers who will judge and review all tied Entries. Tied Entries will be judged again, and additional points will be awarded based on the Entrant’s unique vision: How well does the overall Video convey a truly original approach and point-of-view – 10 points possible. Judges’ decisions are final.

Grand Prize

Honorary one-year membership to the Wahl Education & Artistic Team (“W.E.A.T.”); the complete Five-Star line of Wahl products; a Wahl prize package including branded merchandise to be determined by the Sponsor. Approximate retail value (“ARV”) $1,400.00 USD. Second Prize: Three clippers, three trimmers and Finale; Membership in Wahl Select Barbers; a Wahl prize package. ARV $700.00 USD. Third Prize: Barber Combo and Finale; a Wahl prize package. ARV $300.00 USD. Total ARV of all prizes is $2,400.00.

Prize winners will be required to sign an Affidavit of Eligibility, Waiver of Liability, Publicity Release Forms, or a Prize Acceptance Eligibility/Liability Release and return them to the Sponsor within 7 days of the date Sponsor sends them to winners. Prize winners may also be required to provide signed model releases to Sponsor. Prizes are nontransferable, except at Sponsor’s sole discretion. Prizes, prize details and prize availability are subject to change, in which case Sponsor may substitute a prize of equal or greater value. No substitutions or cash redemptions, except at Sponsor’s sole discretion. Any portion of prize not used by winner is forfeited and no cash substitute will be offered or permitted. Prize offered is provided “as is” with no warranty or guarantee either expressed or implied by Sponsor. Awarding of all prizes is subject to verification of Entry, submission of all required Release Forms, eligibility, and compliance with these Official Rules. Sponsor will attempt to contact winners in person, by phone, email and/or overnight mail, at the Sponsor’s discretion, on or about approximately 14 days after the Judging is complete. Potential winner must respond within 7 business days of initial notification attempt.

Claiming Prizes

Winners are subject to verification by the Sponsor, whose decisions are final. If there is noncompliance with these Official Rules, if winner does not respond within 7 business days of initial notification attempt, if prize notification or attempted notification is returned as undeliverable, if winner is deemed ineligible for any reason, if winner does not return all required forms by the deadline established by Sponsor, or if winner declines prize offered, prize will be forfeited and awarded to the Entrant with the next highest score, time permitting. All properly claimed prizes will be awarded provided a sufficient number of eligible Entries are received, but in no event will Sponsor award more prizes than are provided for in these Official Rules. By participating in the Contest, Entrants acknowledge compliance with and agree to be bound by these Official Rules, the decisions of Sponsor, which are final in all respects, and all federal, state, and local laws and regulations.

Conditions

All federal, state and local taxes, if any, are the sole responsibility of winners. Each winning Entrant grants Sponsor a royalty-free, worldwide right and license to use and publish his/her first name, first initial of last name, city/town and state of residence in connection with the Contest. Acceptance of a prize constitutes permission for Sponsor and its affiliates and licensees to use winners’ names and likenesses solely for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law. By participating in the Contest, Entrants agree to release and hold the Sponsor, any other entity involved in the development or administration of the Contest, Facebook, Instagram, YouTube, TikTok, Twitter and all of their directors, officers, employees, members, affiliates, and assigns harmless against any and all claims and liability arising out of Contest participation and (if applicable) acceptance/use of a prize and prize-related activity. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or acceptance/use of any prize or prize-related activity. Sponsor is not responsible for any typographical or other errors in the printing, the offering, the announcement of any prize, or in the administration of the Contest. Sponsor reserves the right in its sole discretion to modify, terminate or suspend this Contest should viruses, bugs, technical errors, fraudulent activity, unauthorized human intervention or other similar causes corrupt or impair the administration, security or fairness of the Contest (“Disruption”). If the Contest is subject to Disruption, Sponsor will determine the winners by applying the Judging Criteria to eligible, non-suspect Entries received as of the date of the Disruption, provided the Disruption does not prevent this process. If the Contest is subject to Disruption, Sponsor will post notice on the Website. Sponsor is not responsible for interrupted or unavailable network, server or other connections, miscommunications, failed telephone, computer hardware, software and other technical failures of any kind, including injury or damage to any person’s device relating to or resulting from participating in or experiencing any materials in connection with the Contest. Sponsor is not responsible for any human error that may occur in the processing of the Contest, nor is it responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of, Entry procedure, whether caused by the Entrant, or otherwise, any of the equipment or programming associated with or utilized in this Contest, or otherwise. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the Entry process or the operation of the Contest; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner or in an annoying, abusive, threatening, or harassing manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance. If there is any conflict between any term of these Official Rules and any marketing or other materials used in connection with the Contest, the terms of these Official Rules will govern.

Jurisdiction/Choice of Law

By submitting an Entry, Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or prizes awarded, will be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with submitting an Entry but in no event attorneys’ fees; and (c) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you in whole or in part. All Entrants agree, by participation in the Contest, to submit to the personal jurisdiction of the federal and state courts located in or closest to Whiteside County, Illinois, which will be the exclusive fora for any dispute regarding any Official Rule or activity associated with the Contest. Illinois law will govern this Contest, without regard Illinois’ choice of law rules.
